2. Scope of these terms

These terms govern purchases of goods through the PAPAcou online store and the related rights and obligations of the seller and buyer.

A consumer is an individual who is not acting in the course of their business or profession when purchasing. Specific statutory consumer rights apply to business purchases only where required by law or expressly agreed.

The purchase information includes the description of the selected product, chosen configuration, price, shipping terms and returns rules applicable when the contract is concluded.

These terms do not exclude or limit consumer rights guaranteed by mandatory law.

3. Products and hand production

PAPAcou primarily offers handmade leather notebooks, covers, accessories and personalised products.

The essential characteristics, contents and available customisation options are stated for each product. Only accessories and customisations stated in the description or selected by the customer form part of the order.

Leather is a natural material. Individual products may differ in texture, grain, natural markings or shade. Leather may develop a patina with use.

Photographs illustrate the products. Lighting and screen settings can affect colour appearance. These circumstances do not exclude the seller’s responsibility for the product’s conformity with its description and agreed characteristics.

Hand production or engraving does not mean that the customer loses statutory rights concerning defective goods.

4. Ordering and conclusion of the contract

Select goods in the store, configure the available options and add them to your cart. Before submitting the order, you can check and correct the selected goods, quantity, configuration and your details.

Before you complete the purchase, the order price is displayed, including selected accessories, delivery and any other stated charges.

By submitting an order using a button that clearly indicates an obligation to pay, you place a binding order.

We confirm receipt of the order by email. If the email is only an automatic acknowledgement of receipt rather than acceptance by the seller, it must clearly say so. The sales contract is concluded when the seller accepts the order.

For individual commissions whose price or design still needs to be agreed, the contract is concluded when both parties approve the specific offer.

If we cannot fulfil the order as agreed, we will contact you. We will not impose a substitute product, a different price or a material design change without your consent.

Please keep the order confirmation and related correspondence.

5. Prices and payments

The product price is shown in the store. The price of personalisation and other optional accessories is displayed when selecting them or in the order summary.

For consumers, the binding price is the final price displayed before order submission, including applicable taxes and fees. Shipping costs are shown separately.

You may use the payment methods available at checkout when purchasing. Availability of a particular method may depend on the customer’s device, currency or country.

For payment by bank transfer, follow the details and payment deadline in the payment instructions.

If advance payment is agreed, production begins once payment and the necessary materials have been received. The customer must be informed of this condition before the contract is concluded.

We may change the price after the contract is concluded only by agreement with the customer or where permitted by law.

6. Personalisation and customer materials

When ordering a personalised product, carefully check names, initials, texts, spelling, the selected side of the product and uploaded images.

Supply materials of a quality suitable for the agreed customisation. If we find that materials are unusable or require clarification, we will contact you.

If design approval forms part of the order, production of the relevant customisation begins after approval. Changes after approval or after production has begun are handled individually, subject to feasibility and agreement on any costs.

The customer is responsible for having permission to use the photographs, logos, images or other materials supplied. They provide them to the seller for preparing and fulfilling the order.

Providing materials does not, by itself, constitute consent to their use in advertising or to publication of the customer’s personal information.

Statutory rights concerning defects remain applicable to personalised products, including where the delivered product does not match the agreed instructions.

7. Shipping and delivery

For Slovakia and Czechia, we offer:

Standard delivery:

  • €8 per order.
  • Normal delivery including production and shipping in 1 to 3 weeks, most often within 2 weeks.
  • Timing depends on personalisation and the workshop’s current workload.
  • For complex personalisation or high seasonal demand, production may exceptionally take up to 30 calendar days, followed by 1 to 3 calendar days of shipping.
  • The production range of 4 to 30 days and total allowance of up to 33 days cover exceptional situations; they are not the normal delivery time.

Express delivery:

  • €35 per order.
  • Priority processing and production.
  • Total delivery in 3 to 7 calendar days, including production and shipping, for orders where express delivery is available.

Shipping after dispatch takes 1 to 3 calendar days. For standard delivery, this is added to production time; for express delivery, it is already included in the total of 3 to 7 calendar days. All days stated are calendar days.

If advance payment is agreed or production requires additional or approved materials, the delivery period begins once these conditions have been met. The customer must be informed of them before the contract is concluded.

A different delivery period may be expressly agreed in advance for an individual commission. Such an agreement takes precedence over the general period.

The applicable delivery method, price and agreed period must be known to the customer before order submission. If we identify a likely delay, we will inform you. Notice of a delay alone does not change the agreed period or limit your statutory rights.

Delivery to other countries is possible only if available for that country at checkout or individually agreed, including its price and delivery period.

8. Receipt of goods

We recommend checking the parcel’s condition on delivery. If damage is visible, we recommend taking photographs and asking the carrier to make a record.

The absence of photographs or a carrier’s record does not, by itself, exclude the customer’s statutory rights concerning defective or damaged goods.

If the seller arranges transport through an offered carrier, the risk of damage or loss in a consumer purchase passes to the customer when the customer or their designated person other than the carrier receives the goods.

For a delivery problem, contact us at papacou26@gmail.com.

9. Withdrawal and returns

For standard, non-personalised goods purchased online, the consumer has the right to withdraw without giving a reason within 14 calendar days of receiving the goods.

You may notify withdrawal by email to papacou26@gmail.com or in writing to the seller’s address. Sending the notice before the period expires is sufficient to meet the deadline.

The goods must be sent or handed over to the seller within 14 days of withdrawal.

For withdrawal without giving a reason, the customer bears the direct return costs if properly informed of this obligation before the contract was concluded. We do not charge a flat restocking fee.

For withdrawal from the entire contract, we refund payments received, including the cost of the least expensive standard original delivery method available when purchasing. The surcharge for a more expensive method, such as express delivery, need not be refunded.

We refund payments within 14 days of receiving the withdrawal notice. We may withhold the refund until the goods or proof of dispatch are received, whichever occurs first, unless we offered to collect the goods ourselves.

The statutory right to withdraw without giving a reason does not apply to products made to the consumer’s specifications, made to measure or clearly personalised, for example with a name, initials, text, logo or image.

Hand production, production after ordering or selection from standard catalogue options does not automatically exclude the right of withdrawal.

The exception for personalised products does not limit rights concerning defects.

Full information, the returns procedure and a model withdrawal notice are available in the Returns and complaints policy.

10. Complaints and liability for defects

The seller is liable for defects to the extent provided by applicable law. These rights also apply to personalised products.

For new goods, the consumer may exercise statutory rights concerning defects that become apparent within two years of delivery, subject to the conditions laid down by law.

For a valid complaint, subject to statutory conditions, the customer is entitled to repair or replacement, or, where applicable, an appropriate price reduction or withdrawal from the contract.

You may make a complaint at papacou26@gmail.com or in writing to the seller’s address. Provide details identifying the purchase and describe the defect. Photographs are helpful but are not a condition for accepting a complaint.

We will provide written confirmation that the complaint has been made. We will handle it without undue delay, no later than 30 days after it is made, and inform you of the outcome.

For a valid complaint, the seller bears the necessary costs, including necessary shipping.

Detailed complaints procedure

11. Personal information

We process personal information primarily to handle orders, communicate, deliver goods and meet legal obligations.

Details of processing and customer rights are available in the Privacy policy.

Shopify privacy information

Submitting an order does not, by itself, constitute general consent to optional marketing or the use of optional cookies.

12. Use of the website and content

Use the website in a manner that does not violate the law, the rights of others or the security of the store.

Texts, photographs and designs may be protected by intellectual property rights. They may not be used in a way that infringes those rights without the relevant permission.

Links to external websites provide additional information. This does not affect the seller’s responsibility for their own contractual and statutory obligations.

13. Complaints and out-of-court dispute resolution

If you are dissatisfied with how a complaint was handled or believe we have infringed your consumer rights, you may send a request for redress to papacou26@gmail.com or the seller’s postal address.

If we reject the request or do not respond within 30 days of it being sent, you may submit a request for alternative dispute resolution to the competent alternative dispute resolution body.

For disputes within its remit, that body is the Slovak Trade Inspection:

Slovenská obchodná inšpekcia
Bajkalská 21/A
827 99 Bratislava
Email: ars@soi.sk

Information on the procedure and conditions

The possibility of alternative dispute resolution does not limit the right to bring a case before the competent court.

14. Governing law and changes to the terms

Contractual relations are governed by the law of the Slovak Republic. This choice of law must not deprive the consumer of protection provided by mandatory provisions of the law of their country of habitual residence where those provisions apply to the contract.

The terms agreed when the contract was concluded apply to the specific order. A later change to these terms does not, by itself, change an existing contract.

If any provision is invalid or unenforceable, the other provisions remain unaffected insofar as they can stand independently. The consumer’s statutory rights remain preserved.
